**Please make sure the contract is read, and if you have questions - contact me.  There has been a HUGE problem lately with people not abiding by this contract.  Please note - spay/neuter must be completed by 6 months, whether it be on or before - NO MORE EXCEPTIONS.  Do not agree to this and then ignore that fact.  Too many times people have said "oh, we just needed to wait, or my vet wants to wait...".  It is not ok to ignore this contract, as it is a legal binding contract.  Do not wait for me to contact you with a problem**

 This contract is the full agreement between the buyer and the seller of the puppy.   All puppies are sold on a spay/neuter contract. The pup is sold as pet quality only, and is not to be used for breeding, or shows requiring an unaltered pet.   It is agreed that any registration papers, if applicable,  will remain with the breeder until acceptable proof of spay/neuter has been received from the buyers veterinarian.  Proof of alteration must be received by 6 months of age, or a fee of $450.00 will be assessed, and legal action will be taken.  

   

                 , defined as breeder/seller -  guarantees the below described Shih Tzu, to the best of the sellers knowledge, is in sound health and free of communicable diseases.  We guarantee the below described puppy against any genetic defects for a period of 6 months.  If a problem is found, you must contact me first.  Then, providing a diagnosis from two licensed veterinarians, I agree to replace the puppy with another puppy of the same sex of mutual agreement between the buyer and seller or refund purchase price, less the deposit.   The puppy and all paperwork associated with the pup are  to be returned to the breeder, and arrangements to do so must be made within 48 hours of vet exams for this contract to remain in effect.  All fees that are incurred upon returning the puppy shall be the responsibility of the buyer.  Buyer can elect to keep the puppy, and by doing so is assuming all costs for the care of the puppy, and is entitled to no refund.   If at any time, the breeder no longer breeds Shih Tzu,  for any reason, the contract becomes null and void.

 The puppy has been vet examined and has been vaccinated and microchipped.  You will be given all applicable paperwork, with the exception the AKC papers if applicable, which will remain with the breeder as described above. 

 

You as the buyer, agree not to sell, trade, lease out, euthanize or give away the dog without the written permission of the seller.  If the buyer can no longer keep the dog at any time during the dog's life,  for any reason, please notify me, and it is agreed that, at the buyer's expense, the dog will be returned to the breeder, with all applicable paperwork, or I will find a suitable home for the puppy to placed in, again, at the buyers expense if any are to occur.   If any of the aforementioned occur, and breeder has not been given first refusal or notification of intent, legal action will be taken,  due to a breech of contract.  Buyer will responsible for any and all legal fees occured, and purchase price of the pup shall be used as the basis.

 

You agree to provide adequate food, water, housing, immunizations and health care, and humane treatment for the dog.

 

You agree to prevent the dog from breeding and buyer agrees to have dog spayed/ neutered within 6 months, but not later than 6 months, per date on contract stated below.  Upon the receipt of spay/neuter (provided by your vet in the form of a certificate or on letter head, and a paid bill showing that this procedure was performed and paid for).  You will then receive your AKC paperwork, if applicable. 

 

*Adult sizes and colors (a puppy's color can change drastically up until usually 18 months) are estimate only, based on seller's experience and recognition.  There are NO size/color guarantees made. 

 

*Umbilical hernias, open fontanels (soft spots on the skull),  and pinched nostrils are very common in the Shih Tzu breed and are not a genetic hereditary or life threatening condition, and there fore not bound by this contract.    Shih Tzu puppies commonly snore, snort, sniffle, or bubble.  These symptoms are of no cause for concern if nasal discharge is clear and the pup seems happy.  When a puppy is teething these symptoms may increase.  Slightly pinched nostrils are common in this breed and normally correct themselves as the pup matures.  This health guarantee does not include stress induced illnesses such as hypoglycemia, coccidia, worms, ear mites, and/or kennel cough.

 

Please choose a vet who is knowledgeable and experienced with this breed. 

Replacement guarantee will be terminated if puppy was abused, does not have up to date records of vaccinations and fecal records.  Seller of this puppy is not responsible for any vet bills of any type or any refunds of vet bills at any time.   * Smaller sized shih tzus are not recommended to go to homes where there are small children.  This can be risky.   Please use your descretion when buying a pup.   

 

By signing this agreement, you have willingly agreed to have your puppy spayed/neutered.  You also agree not to attempt any charge backs or refunds without the sellers knowledge.  You agree that if you cannot keep the dog for any reason, breeder shall be notified first.   You agree that you fully understand this contract, and the conditions within.

 

 

ANY LEGAL ISSUES BETWEEN BUYER AND SELLER ARE SUBJECT TO NEW YORK STATE LAWS.   OUT OF STATE LAWS ARE NOT VALID PER THIS GUARANTEE.  ALL LEGAL ISSUES WILL BE DEALT WITH IN THE STATE OF NEW YORK, SCHOHARIE COUNTY, AND ALL LEGAL FEES WILL BE THE SOLE RESPONSIBILITY OF THE BUYER.

My contract is  written to insure the safety and well being of my puppies - period.  While I take every step possible to make the contract fair to all parties, I understand that there are special circumstances that come up from time to time.  Over the years I have modified this contract to better suit the desires of all parties involved.  I provide all potential puppy buyers with our contract via internet BEFORE the puppies are born.  This contract is set for public viewing, and there fore is a binding contract, whether signed or not.  I am steadfast in my request that I am ALWAYS  notified and allowed to take the puppy back should the need arise.  Please feel free to contact me if you have any further questions about my policies or guarantees.

 

Please note that ALL of our dogs are AKC registered, first and foremost.  We have made the decision to no longer offer the puppies with paperwork, with the exception of a few litters, due to breaches.  If you are insistant about paperwork, contact me via email prior to purchase.

 

**Pups that are not going to be kept by the original buyer, as stated in the contract, must be returned to me, unless I make other arrangements for you. 

*Returning a puppy is ALWAYS the responsibility of the BUYER.  **If and when a pup is returned to the breeder, regardless of the issues at hand...

Buyer may or may not be refunded for the dog.  Do not expect the full amount.  Buyer will be responsible for ALL fees, which includes vet exams, and treatments necessary that may follow.  Vet exams on returned pups is done within 3 days by my vet.  Refunds, if applicable - will be based on the condition and age of the dog.

 

**In reference to older dogs that may be placed : **BUYERS REMORSE WARRANTS NO REFUNDS...  NO EXCEPTIONS!!!!!!!  Placing an older dog is not a task I take to lightly - it is something that I explain to you, and make sure you understand.  But dogs are not store items, you cannot just take them a few days to try them out, and bring them back. 

**Older dogs that are placed with open registration:  - Are sold with absolutely no guarantees and no refunds are given on dogs sold in this manner.  We cannot and will not guarantee how the dog will work in your situation, the breeding ability of the animal, and so on.  Buying an older animal for breeding is a risk that the buyer assumes, plain and simple.   Again - no guarantees, no refunds.  We have never purchased older animals, especially not for breeding purposes. 

 

***"NEW PUPPY" NOTE TO ALL PARENTS***

"The change of environment may be traumatic and cause stress-related
problems:

  a.. Coccidiosis (a type of intestinal infection)

  b.. Tracheobronchitis (a relatively minor upper respiratory problem) and / or kennel cough

  c.. Hypoglycemia

  d.. Dehydration (usually from not drinking enough water)

These physical problems are often brought on by unavoidable stress, and are
similar to problems you might have if you were moving to a new area. Just
like you, the puppy may not eat or sleep as regularly as it would in more
familiar surroundings. Some puppies ease through the transition to their new
home, while others may have harder time. If stress-related problems are
ignored, secondary problems can become serious, even life threatening. "

 

**While we do our best to make sure our pups are completely healthy when going to a new home, we are only human and not fortune tellers and cannot read the future.  Issues such as coccidia and kennel cough may arise (see above) amongst some other common puppy ailments that were not present at time of delivery.  Some of these common ailments have longer incubation periods so may or may not show up at time of "delivery".  Please know that if your puppy experiences any of this, please contact us.  While these common items are visited in our contract and are not covered, we would still like to know.**

If a situation arises, and you are no longer able to care for your Willow Rose baby...please let me know.  My bred by babies are my number one concern, for the duration of my and their lives. I will take back any of my bred by babies at any time, for any reason.  I would rather have my babies back, then placed in a shelter or some other undesirable circumstance.
